The Verkhovna Rada adopted on the whole the presidential bill “On a special procedure for removing the President of Ukraine from office (impeachment).” According to an Interfax correspondent, 245 deputies voted for such a decision on Tuesday, September 10.
According to the bill, the Verkhovna Rada can remove the President of Ukraine from office by impeachment only in case of committing treason or another crime.
The basis for initiating impeachment is a written submission signed by a majority of deputies of the Rada, whose signatures are not revoked. The Ukrainian parliament by a majority vote decides to remove the president from his post and include this issue on the agenda of the session of the Verkhovna Rada “as urgent,” the text of the bill says.
If this issue is included on the agenda, the Rada creates a special temporary investigation commission to conduct an investigation of the fact and circumstances of the commission of treason or other crime by the president. The president, in turn, according to the bill, can use the services of defense attorneys during the impeachment procedure.
The plenary meeting of the Rada, at which the conclusions and proposals of the commission are considered, should be open, except when the voiced information constitutes state secrets.
After the Verkhovna Rada decides to accuse the president, parliament must appeal to the Constitutional and Supreme Courts. “In the event that the conclusions of the Constitutional Court and the Supreme Court are received, respectively, on the observance of the constitutional procedure for the investigation and consideration of the case of impeachment and that the acts of which the President of Ukraine is charged contain signs of treason or other crime, the Verkhovna Rada … decides the removal of the President of Ukraine from office in impeachment order … The resolution shall be considered adopted if at least 3/4 of the Ukrainian people’s deputies from the constitutional composition of the Verkhovna Rada vote for it, ” – the bill says.
In case of failure by the Verkhovna Rada of the resolution on impeachment, the chairman on behalf of the parliament apologizes to the head of state. The resignation of the president of his own free will is the basis for terminating the impeachment procedure at any stage, as well as for closing the relevant proceedings in the Constitutional and Supreme Courts.
The bill on impeachment of the president at the end of August was introduced to the Ukrainian parliament by head of state Vladimir Zelensky.
